1. What does the County Appraiser do?

By law the County Appraiser is responsible for listing and valuing property in a uniform and equal manner. The appraiser determines the appropriate value of your property. The amount of taxes you pay depends on the budgets set by local government, special assessments and an amount collected by the state and redistributed to public schools.

2. How do I find the value of a particular property?

Real Estate Property values are available online or you may call (785) 628-9400 for assistance.

3. How much did my neighbor's house sell for?

Kansas law considers sale prices to be private. However, if you are thinking of appealing your own house's value, you then have the right to see sale prices of other similar homes. Contact the appraiser's office at (785) 628-9400 for more information.

4. My neighbor's property value went down, why did mine go up?

Each home is valued by comparing it to the five most similar properties that have recently been sold. Adjustments are made to those sale prices for any differences and the result is what your home might sell for. Each year older sales are deleted and newer sales are added. Your home and your neighbor's will almost always be compared to different sales, producing different results. Your values and your neighbor's values are at the mercy of whether your five comparison houses sold higher or lower.

5. How does the county's appraisal affect my taxes?

If your property value goes up, it does not necessarily mean you will pay more taxes. Likewise, if your property value goes down or does not change, it does not automatically mean you will pay less or the same amount of taxes. Changes in property taxes are based in large part on how much your local government decides to spend on services each year.

6. Will the value of my home change every year?

The value of your home may change each year. It depends on market conditions, improvements to your property, etc. The County Appraiser continually reviews and records sale prices and other information on homes all over the county.

7. What is property appraised at?

Homes, commercial real property and certain other property categories are appraised at "market value" as of the first of January each year. Market value is the amount of money a well-informed buyer would pay and a well-informed seller would accept for property in an open and competitive market without any outside influence. Land devoted to agricultural use, light passenger motor vehicles, and commercial and industrial machinery and equipment are appraised using a value based method, however it is not "market value".

8. How does the County Appraiser determine market value?

When valuing your home, the appraiser determines the age, quality, location, condition, style and size of your property. The appraiser then uses one or more of the following three methods to value real property. The comparable sales approach: sales of similar property are compared to the property being valued (subject). The appraiser then adjusts for differences (for example, one house may have more square footage than the subject). This method works well for valuing homes. The cost approach: the cost to replace your property is adjusted for age and condition. This approach works well for new and unique properties. The income approach: in general terms, income from rent is used to value property. This method works well for income producing properties (for example, apartment buildings and most commercial properties.

9. Does the County Appraiser visit my home?

State law requires the County Appraiser to view and inspect all property in the county once every six years. Your county appraiser may view and inspect your property more than once every six years due to market conditions and for quality control. It is the owner's responsibility to report to this office when a building is destroyed, burned, etc .

10. If I bought my house last year, shouldn't the value be the same as what I paid for it?

One sale by itself does not determine market value. A single sale may not represent the market value. The price you paid for your house is verified by the County Appraiser and then considered along with sales of similar properties. The appraiser uses this information to appraise your home.

11. When will I be notified of the value of my property?

Notices of value are sent to the owner, as recorded in the Register of Deeds Office, by March 1 for real property.

12. How can I determine if the appraisal of my home is accurate?

You can visit the County Appraiser's Office to review information on similar properties and verify that the information the appraiser's office has on your home is correct. If a neighbor has a similar house which recently sold, the sale price may also give you an indication of the value of your house. In addition, real estate professionals can provide information about market conditions in your area.

13. What can I do if I do not believe the value of my property is correct?

Use one of two ways to challenge the value of your property: you may appeal the "notice of value" of your property by contacting the County Appraiser's Office by phone or in writing within 30 days from the date of notice for real property and May 15th for personal property, or you may fill out a "payment under protest" form with the County Treasurer at the time you pay your taxes. If you paid all your taxes prior to December 20th then the protest can be made no later than December 20th (unless an escrow or tax service agent pays your property taxes, then no later than January 31st). You cannot appeal using both methods for the same property in the same tax year. So, if you start to appeal your "notice of appeal", be sure that you follow through with the appeal. You will not be allowed to "pay under protest" later. If you are not satisfied with the results of your appeal at the county level, you may take your case to the Kansas Board of Tax Appeals. 14. How do I calculate the property taxes on my property?

(1) Looking at your notice of value, find the assessed value. (2) Multiply the assessed value by your mill levy and then divide by 1,000 to estimate the property tax you owe. You can find your mill levy on last year's tax statement or contact the County Clerk.

15. What is the mill levy and how is it set?

The mill levy is the tax rate that is applied to the assessed value. In general terms, the mill levy is determined by dividing the dollars needed for local services by the assessed property value in the service area. An additional amount is then added for public schools. After the local government budgets are published and hearings are completed, the County Clerk computes the final mill levies for each tax unit and certifies the tax roll to the County Treasurer for collection.

16. Who pays the taxes due on property I sold or purchased?

Except for certain motor vehicles, property tax due on personal property is the responsibility of the owner of record January 1 of each year. For real property, if not addressed in private contract, the seller is responsible for the property tax if the property is sold on or after January 1 and before September 1. The buyer is responsible for the property tax if purchased on or after September 1 and prior to January 1 (K.S.A. 79-1805). Private contracts between buyer and seller will often specify who pays the taxes. KSA 79-1805

17. How is real property classified and assessed in Kansas

Article 11, Section 1 of The Kansas Constitution provides that: Real property shall be classified into seven subclasses and assessed uniformly by subclass at the following assessment percentages:
(1) Real property used for residential purposes ------ 11.5%.
(2) Land devoted to agricultural use ----- 30%.
(3) Vacant lots ----- 12%.
(4) Real property owned by a not-for-profit organization ----- 12%.
(5) Public utility ----- 33%.
(6) Real property used for commercial and industrial ----- 25%.
(7) All other real property ----- 30%.

18. Are property taxes prorated between buyer and seller?

Property is not prorated on the tax roll when acquired and is not prorated off the tax roll when disposed of (K.S.A. 79-309). However, private contracts between buyers and sellers will often prorate the property tax. The only exceptions to this are for motor vehicles and when taxable property becomes exempt or exempt property becomes taxable. KSA 79-309

19. How is personal property classified and assessed in Kansas?

Article 11, Section 1 of The Kansas Constitution provides that: Tangible personal property shall be classified into six subclasses and assessed uniformly by subclass at the following assessment percentages:
(1) Mobile homes used for residential ----- 11.5%.
(2) Mineral leasehold interests ----- 30%.
(3) Public utility tangible personal property ----- 33%.
(4) All categories of motor vehicles ----- 30%.
(5) Commercial and industrial machinery and equipment ----- 25%.
(6) All other tangible personal property ----- 30%.

20. Who needs to list personal property for taxation?

K.S.A. 79-303 states, "Every person, association, company or corporation who owns or holds, subject to his or her control, any taxable personal property is required by law to list the property for assessment."

If any person, association, company or corporation has in their possession or custody any taxable personal property belonging to others, it shall be their duty to list the property with the appraiser in the name of the owner of the property. KSA 79-303

21. Who must sign the personal property rendition?

By law, every person, association, company or corporation required to list property must personally sign the rendition. In addition, if a tax rendition form preparer prepared the rendition, then the tax preparer must also sign and certify that the information presented therein is true and correct (K.S.A. 79-306). 22. When and where does a taxpayer file a rendition?

K.S.A. 79-306 requires all taxable personal property to be listed, by a taxpayer, on a rendition (also referred to as a 'statement') and filed with the County Appraiser on or before March 15th of each year, or the next following business day, if such date falls on a day other than a regular business day. Oil and gas renditions are to be filed on or before April 1st.

The County Appraiser may extend the March 15th deadline if the taxpayer submits a request in writing, stating just and adequate reasons for the extension, and is received by the County Appraiser on or before the March 15th due date, April 1st for oil and gas rendition. KSA 79-306

23. What penalties apply to personal property?

If personal property is not listed or if a rendition is untimely filed, the County Appraiser is required by law to apply any applicable penalties. These penalties are set forth in K.S.A. 79-1422 and K.S.A. 79-1427(a) as follows:

The County Appraiser has the duty of listing and appraising all tangible personal property in the county that is owned by, held, or in the possession of a business. If a taxpayer fails or refuses to file a rendition or, if the rendition filed does not truly represent all the property, the County Appraiser has the duty to investigate, identify, list and value such property in an effort to achieve uniformity and equality (K.S.A. 79-1411(b) and K.S.A. 79-1461). 24. Do I have any appeal for the penalty?

The State Court of Tax Appeals (COTA) has the authority to abate any penalty imposed under this section and order the refund of the abated penalty. In order to appeal a penalty the taxpayer should obtain the proper form from the County Appraiser's Office, complete the form, and submit it to the county. The county would then submit the form to the COTA for consideration. Either party may request that COTA rehear or reconsider its decision if such request is made within 15 days from the date of the COTA decision.You may print a copy of the form by going to www.accesskansas.org/bota and then choose Applications/Instructions/Flow Charts and look for Tax Grievances (TG) Appeals.

25. How are motor vehicles appraised?

(1) Motorcycles, automobiles and light trucks that are tagged to operate at less than 12,000 pounds or less on public roads are appraised for tax purposes using a formula set forth in laws. The motor vehicles approximate base wholesale price (dealer cost) when first sold to the public is used to "classify" the vehicle within a price range. The mid-point of this price range is then reduced 15% per calendar year (K.S.A. 79-5100 series).

(2) Motor vehicles operating over 12,000 pounds, or non-highway motor vehicles, are appraised at market value. The market value is generally obtained using valuation publications prescribed by the state.

(3) Automobiles owned and leased for a period of time not exceeding 28 days by a car rental company have an excise rental tax imposed in lieu of property tax (K.S.A. 79-5117).

(4) Motor vehicles used by, for hire motor carriers over the road to transport persons or property are state-assessed. 26. Can my boat (and motor) valuation be prorated?

The Appraiser's Office is allowed to prorate the vessel valuation per the date of sale or acquisition, between January 1 and September 1. After September 1st only the sold vessel can be prorated. If a vessel is sold within the first half of January, the full year valuation will go to the purchaser. The owner for the majority of the transaction month will have that month added to his prorated valuation Effective July 1, 2007, due to HB 2044 amending KSA 79-306e), to have the vessel prorated the property owner must notify the Appraiser's Office on or before December 20th of the year of such acquisition or sale. If a property owner sold a watercraft, in order to prorate the tax value, the County Appraiser will need to receive a bill of sale. The legislation defines the vessel as "any watercraft designed to be propelled by machinery, oars, paddles or wind action upon a sail for navigation on the water." As the bill reads, the trailer will not be prorated. It is only the boat and the motor.

Crime victims should report their crime to law enforcement so that the crime can be investigated. Once you have reported your crime, if you have further questions, please contact us at (785) 628-9405. We will help you determine the status of your case and answer questions that you have.

3. Where do I report a crime?

A crime must be reported to the law enforcement agency that has jurisdiction over the city or county where the crime occurred. The Ellis County attorney’s office does not investigate crimes. Please call police dispatch at (785) 625-1011 to report your crime. They will refer you, if necessary, to the appropriate agency in Ellis County.

4. As a crime victim, do I have any say regarding bond conditions (including no contact orders)?

The Ellis County attorney’s office attempts to contact victims of crimes prior to bond hearings. However, defendants must be brought before the first available judge as soon as is practical. Most bond hearings occur at 8:30 am on weekdays (Monday through Friday) for persons arrested the previous day. However, bond hearings are often scheduled in between other hearings when the court has time to see the defendant. No Contact Orders

5. As the victim of the crime, is it my decision whether or not to prosecute or file charges?

In the State of Kansas, criminal charges are brought on behalf of the State of Kansas or the municipality in which the crime occurs. The decision whether or not to file a criminal case, how to prosecute, and/or how to resolve the criminal case is up to the prosecutor. As a crime victim, the Ellis County attorney’s office will encourage you to cooperate in the prosecution of the crime and work with the prosecutor toward a just resolution of the case. We will listen to your concerns and consider your opinions as to potential plea agreements and sentencing considerations. However, by statute, the discretion to file charges and to prosecute the case lies with the prosecutor, who uses legal training, experience, and knowledge to seek justice.

6. Who do I contact if I have a question concerning a case in which I am the defendant?

If you are the defendant and have an attorney, please talk to your attorney. If you are represented by an attorney, the Ellis County attorney’s office cannot speak with you about your case. If you are representing yourself and have waived your right to an attorney before the court, you may contact us with questions. The employees of the Ellis County attorney’s office can answer scheduling and procedural questions regarding your case, but cannot give you legal advice.

7. What is a diversion agreement?

A diversion agreement is an agreement between the State of Kansas and a defendant charged with a crime whereby the defendant agrees to comply with conditions set forth by the prosecutor. If all conditions are met, the charge against the defendant is dismissed. Therefore, the defendant does not have a conviction for the offense charged. This is generally limited to first-time offenders and is determined on a case-by-case basis at the discretion of the prosecutor.

8. How do I know if I am eligible for a diversion?

When charged with a crime, you will need to make your first appearance before the court. At first appearance, the court will advise you as to the charges pending against you, determine whether or not you have an attorney or wish to have an attorney, then inquire if you wish to discuss a possible diversion with the prosecution.

9. Who do I contact if I have questions regarding child support?

12. What are my rights as a landlord or a tenant?

Information concerning your rights as a landlord or tenant are contained in the Kansas Residential Landlord and Tenant Act, codified at KSA 58-2540 through KSA 58-2573. 13. Who do I contact regarding a Municipal Court ticket?

14. How do I file a petition for expungement?

If you are in need of advice regarding expungements, please contact an attorney who has experience in this area of the law. The Ellis County attorney’s office does not prepare expungement documents and cannot advise individuals on the expungement process.

15. How do I file a small claims case?

Small claims cases are civil controversies between two private individuals in which the amount of controversy is $2500 or less. Neither side is represented by an attorney in this process. The plaintiff will fill out a claim in the clerk of the District Court’s office, and the case will proceed from there. 1. How do I apply for a Cereal Malt Beverage License?

Obtain the appropriate paperwork from the Ellis County Clerk's office at 718 Main, or download from www.ellisco.net under Department/Clerk.  Return completed paperwork to the Ellis County Clerk along with a $55.00 fee. Once the County Commissioners have approved the permit, it will be forwarded onto the applicant.

2. How do I apply for a Moving Permit?

To obtain a Moving Permit to move a building/structure, derrick, etc. on Ellis County roads, pick up the application at the Ellis County Clerk's office at 718 Main or visit ellisco.net under Department/Clerk to download. All utilities that are affected by the move will need to be notified by the mover. Present the permit to the Ellis County Clerk's office along with a $100 fee after meeting the requirements of notification. The County Clerk's office will then forward the request to Ellis County Public Works Road & Bridge Division for approval of the route. They will notify the Ellis County Clerk once they have authorized approval of the route. The Ellis County Clerk will then sign and seal the permit and forward onto the contractor/mover, who may then proceed with the move.

3. How do I apply for a Passport?

To apply for a passport, you can get the paperwork from the Ellis County Clerk's office at 718 Main, or you may go online to download the proper application @ travel.state.gov. If this is your first-time passport, it must be filed at the Ellis County Clerk's Office or another official passport agency. If you are renewing your passport and are an adult, you file it yourself. 1. My water has a strange taste. Can you test it? Should I bring in a sample?

Our office can test for nitrates and bacteria. We do these tests on Monday, Tuesday, or Wednesday for a nominal fee. Further testing can be done at a certified laboratory. To test water, we take a sample from your kitchen sink to ensure that the proper sampling procedures are followed. We also do a well evaluation at the same time.

2. How often do I have to pump my septic tank?

Septic tanks should be checked annually. We recommend pumping them every five years or as needed.

3. Who do I contact for a chemical spill in the county?

1. Do you accept walk-in appointments?

For some services we do accept walk-in clients provided nursing staff is available. It is best to first call the department at 628-9440 to determine staff availability or if you need an appointment

2. Can I get my blood pressure checked at the health department?

Yes, the Ellis County Health Department offers free blood pressure screens to the public. Currently, there is a walk-in blood pressure clinic scheduled every Friday from 9 to 11 a.m. at the department. In addition, this service is also offered every Tuesday at Ellis (City Hall) and the Hays Senior Center. Blood pressures are also provided on Tuesdays and Thursdays at Centennial and Epworth Towers respectively. Call the department at 628-9440 for information and clinic times.

3. How often should I be checked for prostate cancer?

Prostate problems are common in men after the age of 50. Therefore, many doctors think men, age 50 and older, should get a yearly prostate exam.

Health - Child Health

1. Can I get my child's vaccinations at the health department?

Yes. The Health Department provides for all vaccinations necessary to complete the children’s immunization schedule. We offer low cost vaccinations charging only a minimal administration fee to those eligible for the VFC and State program. Private insurance payers are assessed the cost of the vaccine plus the same administration fee. In addition, there is no charge for an office visit. Immunization clinics are every Monday or by appointment. Please bring your child’s vaccination record and insurance cards. For more information call 785-628-9440.

2. Can I get my child's school physical at the health department?

Yes, the Ellis County Health Department does offer children's school physicals. School physicals are performed by certified nursing staff of the health department and address all required assessment components. The process should take about an hour to complete. The cost is 50.00. In addition, necessary school vaccinations may be completed at the same time. For an appointment or other questions please call the health department at 628-9440.

1. Do I need an appointment for my child's vaccinations?

The health department has a walk-in immunization clinic every monday between 7:30 a.m. and 4:30 p.m. If a Monday clinic is inconvenient you may call the department at 785-628-9440 and make an appointment to suit your schedule.

2. Do I need a pneumonia shot every 5 years?

Usually only one dose of pneumonia vaccine is needed. However, a second dose is recommended for people 65 years and older if they received their first dose before the age of 65 and more then five years have passed since that first dose.

3. Can I use my debit card to pay for shots?

Yes. The health department does accept Mastercard, Visa, Discover, and American Express debit and creedit cards.

4. Will the flu shot give me the flu?

Absolutely not. The flu vaccine does not contain live viruses but viral protein antigens. Such particles cannot give someone the flu. If you get sick with the flu following a flu shot it was likely you were infected with such 7 to 10 days prior.

Your income must be 185% of the poverty level or less.

4. How many people are on WIC?

During the last Fiscal Year of 2009, the number of women, infants, and
children receiving WIC benefits each month reached approximately 9.3 million. In 1974, the first year WIC was authorized, 88,000 people participated.

Ellis County has about 550 current WIC participants.

5. What do I do with my WIC checks if I move?

Try to contact your local WIC clinic before you move. If you are moving within Kansas, you can still use your WIC checks in the new area. Your new clinic will transfer your records from the previous clinic once you have notified them you are a transfer client. You will be able to receive your food benefits once the transfer is completed. Transfers within Kansas may take 1-2 days to process. If you are leaving Kansas, contact your local WIC clinic for transfer information. Ask for a Verification of Certification form (VOC). Clinic staff will produce the form from the WIC computer program. The WIC Clinic in the new state will use the VOC form to transfer your records and benefit information.

The landfill will accept loads of waste that are co-mingled together; however, the load will be charged at the higher rate. Loads that are separated but are transported together can be charged at their applied individual rates and dumped at their individual locations.

3. Do you accept asbestos?

The landfill will accept non-friable asbestos, but it must be wet or covered when transporting. Notify the Landfill prior to transporting. 4. How much hazardous waste can I bring at one time?

The landfill accepts five gallons or 50 pounds of household hazardous waste from each Ellis County resident per visit.

3. When should I spray musk thistle, and what product will work best?

We recommend either Milestone or Tordon 22K applications either in the late fall just before the ground freezes, or in early spring just after the ground thaws.

Register of Deeds

1. How do I change the name on my deed?

Once a document has been filed in this office, the document itself will not be changed. To transfer the property, you will need to have a new deed prepared. To avoid future legal problems, we recommend that you have an abstracter or an attorney do this for you.

2. What are the requirements for filing a document?

A document has to have a legal description, original signatures, and be notarized. The proper filing fees have to be paid before the document will be recorded. A deed, where the land has been sold to another person for a price, has to be accompanied with a Kansas Sales Validation Questionnaire - a form that assists the county appraiser in assessing the property.

3. My spouse recently died - how do I change the name on my deed?

If you owned the property in joint tenancy, all you need to record is the original certified copy of the death certificate with the original state seal on the back side. This will remove the name of the deceased party from the title to the real estate and leaving your name on. A new deed will not be made, but the records will reflect that one party is deceased.

Persons open and/or conceal carrying firearms are not allowed entry in to the courthouse and will be encouraged to secure the weapon safely before entering the building.

Cell phones are not permitted past the security check point. Lockers are provided for secure keeping while in the building. Exemptions upon approval of the court.

3. Is there a dresscode when attending court?

Courthouse settings and situations are stressful for children. Attendance in court hearings is left to the discretion of the presiding case judge.

Service animals that are individually trained to work or perform tasks for persons with disabilities are allowed in to the building. Service animals must be harnessed, leashed or tethered unless doing so interferes with the service animals' work or the individuals' disability prevents the use of such devices. Emotional support dogs are only admitted per prior approval of the presiding case judge discretion.

1. Do you have the person I'm looking for in custody?

If we have the name of the individual you are looking for, we can tell you if they are in the Ellis County Jail. However, some individuals come in and refuse to fill out paperwork and their identification takes longer to verify and that increases the amount of time to process an individual through

2. What is the inmate’s bond?

The inmates bond is determined by the jurisdiction the individual was arrested under or being charged by.  Jurisdiction being, Cities of Hays, Ellis, Victoria, or Ellis County, or another county or state. Bonds for charges vary by jurisdiction.

3. When will the inmate have court?

Inmates charged through Ellis County usually will see the judge regarding their charge and/or bond the morning of or after the arrest.  Others inmates with charges through the City of Hays, will see the municipal judge on Monday morning, Tuesday afternoon, or Thursday morning.  Other inmates may not be seen until the judge has reviewed the case file and requests to see them.

4. When will the inmate get released?

The inmate will get released after bond has been posted and any bond conditions are fulfilled.  Some inmates may be released on their own recognizance.

5. When is another county going to pick up the inmate?

An inmate being held for another jurisdiction remains in the Ellis County Jail, until the charging county or state comes to the Ellis County Jail to pick them up for transportation.

6. Can you deliver a message to this inmate?

The only message delivered to inmates are messages from their attorney.  All inmates have access to phone and are allowed 3 free letters every seven days.

7. Can I bring in the inmate’s medication?

Yes, you may bring an inmate medication.  The medication may or may not be approved by the Ellis County Medical provider.

8. Can I bring in money for the inmate?

You can deposit money on an inmates account by going to www.jailatm.com  and then follow to prompts to Ellis County, Kansas.  There is also a kiosk in the entry way lobby of the Ellis County Courthouse and the Ellis County Sheriff's Department.

9. Can you tell me how much money the inmate has on their account?

No, we can not tell you how much money is on an inmates account, as those accounts are subject to the same banking laws that govern the banking system.

10. Can I bring in food or clothes for the inmate?

No, you may not bring food or clothing to an inmate. The only time an inmate is allowed to have street clothing brought to the jail is when an inmate is appearing in a jury trial.  Only one change of clothing is allowed in per day and no neck ties are allowed.

11. Can you tell me if I have any warrants?

No, the jail will not tell you if you have any warrants.

12. When can I visit the inmate?

Visitation for inmates is Tuesday through Friday from 9 AM till 7 PM.  The visitation day is determined by the what pod the inmate is living in.  Special visitation time my be approved by the jail lieutenant if the inmates family is visiting from out of state and their is advance notice of the requested visitation.  You can set up a visit with an inmate by going to www.mticonnex.us and follow the prompts.

13. How many people can visit and how long?

1. I just found a brightly colored civil process slip in my door from your department for someone that used to live at my residence or someone I don’t know. What do I do now?

It's difficult to keep up-to-date addresses for everyone we serve civil papers on. Although one might think that simply throwing the slip away might be more convenient our office will continue leavening notes on your door until we can verify that the subject listed on the slip no longer lives there. Please consider calling our office to verify that the subject no longer lives at your address.

2. How do I report a crime?

For some people this may seem like a foolish question but, the fact is that during a heightened state of panic, anger, shock, and/or despair, simply calling 9-1-1 to ask for help can create an even higher state of anxiety. Knowing what the dispatchers will require from you can reduce stress, and can possibly expedite help to your situation. Here are some suggestions to keep in mind when calling 9-1-1;

Speak clearly and remain calm - Dispatchers must be able to understand what you are saying.

Be ready to give information such as your name, callback number, incident location, and type of incident.

Unless the dispatcher tells you to hang-up, stay on the telephone line.

3. I just found a brightly colored slip in my door from our office. It reads that the Sheriff’s Department has a civil process paper for me. What do I do now?

As the note indicates we have a civil process paperwork that we need to deliver to you. Our department is a 24-hour service, 365 days a year, including holidays. Please call our office at your earliest convenience at anytime to make arrangements for service.

4. I am aware that your office has civil process for me but I’ve heard that if I avoid service I will elude having to go to court and the matter might simply “go away”

Avoiding civil process service is only a quick way to get your self into more trouble. Although it depends on what type civil process it is, if our office can’t locate you before the posted court date we simply return the paper to the court. A Judge may then issue a warrant for your arrest. Other circumstances might warrant a deputy stopping by your place of work or school if we can’t make any contact at your residence. Don’t believe what your see in the movies and television, avoiding civil process service doesn’t make the problem “go away” it only make the problem worse.

5. When should I call 9-1-1 opposed to calling on the Sheriff's administrative line (785) 625-1040?

When a crime is in progress (a prowler in your yard, a person seen breaking into a home or car, or a fight with or without weapons.)
When you see fire or smoke
During a heart attack, or other serious, medical condition or injury
Any situation requiring the immediate response of a fire truck, ambulance or law enforcement vehicle.

6. What is Civil Process?

Civil process is the handling and serving of legal and court documents such as:

summons dissolution of marriage subpoena restraining order

foreclosure eviction protection order judgment

Civil documents are served on behalf of individuals, private attorneys, the Court, county departments and agencies.  These documents can be served by private process servers, however many people choose to use the Sheriff's Office.

7. Can the Sheriff's Office Resolve Landlord/Tenant Disputes?

The relationship between a landlord and his/her tenant is one of a personal & civil nature. As such, the Sheriff's Office cannot intervene or decide these disputes. If the parties involved cannot reach an agreement, they will have to take their case to court. They may do this by contacting an attorney, or in some cases, they may file a case with the Clerk of the District Court. 8. Will the Sheriff's Office preform a Civil Standby?

The Sheriff's Office occasionally gets requests for a deputy to accompany someone to a residence to retrieve or recover personal property. We will generally try to assist people at the time they call or come in, if the property exchange or retrieval can be handled peacefully within 30 minutes or less. The sole purpose of a deputy's presence is to KEEP THE PEACE. Any property over which ownership is in dispute should be handled in the courts. The deputy may conclude the Civil Standby at any time for any reason he deems necessary.

9. Can the Sheriff's Office preform Background Checks?

The Ellis County Sheriff's Office can provide information deemed public by the Kansas Open Records Act. However, the Sheriff's Office is prohibited by law from running a criminal history background for you by utilizing the National Crime Information Center. Residents can obtain a more thorough, statewide background check by visiting the Kansas Criminal History Record Check website.

10. How can I file a Missing Person’s Report?

Missing/Runaway  Juveniles: The parent or guardian of any juvenile (under 18 years of  age) may file a missing person-runaway juvenile report at any time.  These reports will be immediately entered into the NCIC law enforcement  database, which would serve to alert any officer from any jurisdiction  having contact with the juvenile that he or she is listed as missing or a  runaway. Deputies will also follow-up on any leads provided by the  parent or guardian as to the possible location of the juvenile.

Missing Adults: Any person eighteen (18) years of age or older is  considered to be an adult with full liberty to move about as they  choose, with the exception of persons 18 years of age or older who  remain under the legal guardianship of another adult or protective  services. Deputies will take reports of missing adults at any time. The  extent of any follow-up will depend upon the circumstances of the  disappearance. For example, if evidence indicates that the missing  person was endangered or may have been forcibly abducted, deputies would  immediately begin following up on leads. If the missing person simply has not been seen recently, but no evidence of foul play was found to  exist, then our options and responsibilities in those cases may be  limited under the law. 11. Will the Sheriff's Office preform Welfare Checks?

The Sheriff's Office frequently receives requests to perform welfare checks. These generally occur when people are unable to reach a family member or close friend and are concerned about the health & welfare of that person. A deputy will be dispatched to the address to see if contact can be made. If contact is made, the deputy will conduct a brief informal investigation to determine the physical and/or mental health and well-being of the person, without violating his or her privacy rights. Another type of request is from a parent to check on minor children in the permanent or temporary custody of the other parent. The Sheriff's Office will do a welfare check provided the parent making the request can provide specific reasons based on facts that the welfare of the minor children is in jeopardy.

12. How do I obtain fingerprints for pre-employment?

The Ellis County Sheriff's Office will fingerprint persons upon request as part of pre-employment criminal history background checks. Residents should come to the Sheriff's Office Tuesday - Friday from 10:00 AM to 1:00 PM to have this process complete.

13. Property boundary disputes - What is the solution?

Property  Boundary Disputes: Occasionally, the Sheriff's office is asked to  intervene and settle real estate disputes concerning property line  boundaries.  These are private, civil matters between the parties  involved.  A Judge must settle them in court if the parties cannot agree  among themselves.  We cannot examine property deeds or survey documents  or landmarks to determine or settle property boundary disputes.  We  will take a written report if asked for informational purposes only, but  that must be the extent of our involvement in these issues.  Of course,  if a court issued orders requiring the Sheriff's Office to perform some  act or function relating to a property dispute, we would follow the  order of the court.

14. Where do I pay traffic tickets?

Citations issued by Ellis County Sheriff’s Deputies may be paid, unless required to appear in court, by contacting the Ellis County District Court Clerk's Office.  The Court Clerk’s Office is located on the 2nd story of the Ellis County Courthouse, which is located at 107 W. 12th St. Hays, Kansas. They can be reached Monday through Friday from 8:00 a.m. to 5:00 p.m. or by calling (785) 628-9415.

You may also choose to pay your fine online by visiting the www.CitePayUSA.com website and choosing "Ellis County District Court Court" from the drop-down menu.

You may make an online payment after your citation information is entered into the system.  This typically can take up to five (5) days from the date you received the citation.

The online payment method is only available to those who are not required to appear in court.

15. Will the Sheriff's Office unlock my personal vehicle?

Only in cases of an EMERGENCY, such as a small child being locked inside a vehicle, can the Sheriff's Office send someone to assist with gaining entry to your personal vehicle. Our deputies do not carry any unlocking tools in their patrol cars, and potential liability for property damage will not allow us to unlock personal vehicles.

In non-emergency cases, you would need to call a professional locksmith to assist in gaining entry into your vehicle.

3. How can I pay my Real Estate/Personal Property taxes?

­There are several ways you can pay your taxes.  The easiest way is to pay online by going to either of these two websites, but be advised, that once the tax deadline has passed, you will not be able to pay online.

You can also drop off your tax payment in our drop box that is conveniently located in the alley behind our building.  There is also a drop box in the lobby waiting area in front of our office.

Lastly, you can come by our office during business hours to pay your taxes. 

4. Can I renew my tags online?

As long as it is before your renewal deadline, you can renew your tags online through the KS Webtags system.  Please be advised that all of the following must be true for you to be able to renew your tags online:

1. The vehicle is currently registered in Kansas
2. You must have a Kansas Motor Vehicle registration renewal notice that contains a Personal Identification Number (PIN).   (If you did not receive a renewal notice or have lost it, you can reprint it by going here: http://mvs.dmv.kdor.ks.gov/PrintRenewals/
3. The County shown on your renewal form is correct
4. The vehicle is currently insured by a participating insurance company
5. You must not have moved since you last renewed the vehicle.

5. What paperwork do I need to bring in to register a newly purchased vehicle?

Since all titles are different, it is hard to say exactly what paperwork will be needed.  Please feel free to bring in all your paperwork and we can advise you if there is any further paperwork needed. 

6. Do you accept debit/credit cards?

We do accept debit/credit cards in our office.  However, there is a 2.5% fee that is added to the total of the transaction.  We also accept cash, checks, money orders, and cashier’s checks.

7. When are the Real Estate/Personal Property Tax deadlines?

First half due date: December 20 (Send stub on left with payment)

Second half due date: May 10 (Send stub on right with payment)

*** If the due date falls on a weekend or holiday, the taxes are due the next business day. Payments must be received on or before the due date to avoid penalty. ***

-Real Estate: First half tax becomes delinquent if not paid by December 20. Interest accrues until tax is paid. If the total tax remains unpaid for three years the property being taxed becomes subject to a tax foreclosure sale by the County. The property then can be sold at public auction. Property owners of the property being sold at auction may not bid at the auctions.

-Personal Property: First half tax must be paid by December 20 or the tax becomes due in FULL. Interest accrues on the full amount if the first half is not paid by December 20. Any unpaid personal property taxes are sent to the Sheriff in January of the following year for collection. When using the payment in half option, if the second half payment is not received by May 10th of the following year, the second half uncollected personal property taxes are sent to the Sheriff within one month after the second half deadline of May 10th.

Personal property includes: boats, campers, trailers, non-highway vehicles, oil, mobile homes, jet skis, 16/20M trucks and etc.

8. Is there a drop box that I can put payments in?

For your convenience, our office has two drop boxes.  The first is in the alley on the South side of our building.  The second is located in the lobby waiting area of our office. Both are checked daily. 

9. Where can I get a VIN inspection?
